Membership Terms and Conditions

This Membership Terms and Conditions Agreement ("Agreement") is entered into between CorFit Pilates Pty Ltd, hereinafter referred to as "CorFit Pilates" or "we/us/our", and the individual whose name appears on the membership profile, hereinafter referred to as the "Member". This Agreement governs the use of our reformer Pilates services accessed through our app, studios, and digital kiosks.

1. Membership

1.1. By registering, the Member agrees to purchase a membership that allows access to CorFit Pilates studio facilities, operated 24 hours a day via app-controlled access. 1.2. Memberships are strictly non-transferable and may only be used by the registered Member. 1.3. Minimum age for Members is 16. Members under 18 must provide signed parental consent. 1.4. All Members must download and use the CorFit Pilates app ‘Serenity Bookings App’ for booking, access, and communication. 1.5. By using our services or app, the Member confirms acceptance of these terms and conditions.

2. Fees and Payments

2.1. Membership fees are charged in advance on a weekly, fortnightly basis, or as per the selected plan. 2.2. Payments are processed via our third-party gateway (GymMaster & GoCardless ). The Member agrees to GymMaster’s & GoCardless's terms and privacy policy. 2.3. We offer:

· Twelve-Month Membership (TMM) – 12 Month Contract.

· Flexible Month-to-Month Membership (FMTM)

· Prepaid Membership (PPM) – A prepaid package of 10 sessions to be used within an 8-week consecutive period from the date of first use. These sessions are non-refundable and non-transferable.

· Foundation Membership (FM) – 12 Month Contract. After the initial 12-month term, Members may continue on the same rate provided they maintain an active membership without interruption. Pricing for new Foundation Memberships may increase annually.

· Three-Month Membership (3MM) – 3 Month Contract.

2.4. Membership Cancellations:

· TMM and FM (during the initial 12-month term): Members must provide at least 28 days’ written notice to cancel. A $200 cancellation fee applies. Membership payments will continue during the notice period. These memberships paid in full are non-refundable and non-transferable.

· TMM and FM (after the initial 12-month term): Memberships will convert to a month-to-month arrangement at the same weekly rate originally agreed upon. Members may cancel at any time by providing 28 days’ written notice.

· 3MM (during the initial 3-month term): Members must provide at least 28 days’ written notice to cancel. A $75 cancellation fee applies. Membership payments will continue during the notice period.

· 3MM (after the initial 3-month term): Memberships will convert to a month-to-month arrangement at the same weekly rate originally agreed upon. Members may cancel at any time by providing 28 days’ written notice.

· FMTM: Members may cancel with 28 days’ written notice. Membership payments will continue during the notice period.

· PPM: This is a prepaid membership and is strictly non-refundable and non-transferable.

Cancellations must be requested via email to info@corfitpilates.com.au and must include the Member’s full name and reason for cancellation. All outstanding membership fees must be paid in full before cancellation is processed.

2.5. Failure to pay membership fees or comply with these terms and conditions may result in suspension or termination of membership without further notice. 2.6. A dishonour fee of $7 applies when a direct debit payment is declined by your financial institution. 2.7. We reserve the right, at any time, to change the Membership Fees charged to Members after the first 12-month period. We agree to use reasonable endeavours to provide you with Written Notice of the changes. The changes will take effect 28 days after the Written Notice has deemed to have been received by you. We deem receipt to have occurred 2 business days after the Written Notice was sent. At the end of the 28-day period, you authorise us and/or the Payment Provider to debit the new amount to your account. 2.8. If we provide you with a free trial, you are still required to comply with all provisions of this Agreement. Trial users will have the same responsibilities as full Members, including health, safety, appropriate use of equipment, and adherence to studio access rules. Misuse during trial access may result in denial of future memberships. 2.9. Membership deferral is allowed:

· Standard Members may request a deferral for a minimum of 2 weeks and maximum of 10 weeks per year. 48 hours’ written notice is required.

· Pregnant or postpartum Members (up to 8 weeks postpartum) may request a deferral for up to 6 months with appropriate documentation from a medical doctor.

3. Studio Access

3.1. CorFit Pilates operates on a 24-hour basis. Members can access the studio at any time using our app-integrated entry system. Some periods may be unstaffed. 3.2. Access to the studio is granted only through the CorFit Pilates app and associated access control system. Members must have an active membership and account to enter. 3.3. Members must not allow entry to any other individual under any circumstances. Tailgating (allowing another person to enter) will incur a $20 fee and may result in termination of membership. Members will also be held liable for any damage or injury caused by unauthorised persons. 3.4. Minor children are not permitted inside the studio unless prior written consent has been provided by CorFit Pilates and the child remains supervised at all times. Children are not permitted to use any equipment. 3.5. Members must adhere to studio rules at all times including:

· Wearing appropriate activewear and clean grip socks.

· Wiping down equipment after use.

· Returning all equipment to its designated area.

· Respecting other Members and keeping noise to a minimum.

4. Noise Policy

At CorFit Pilates – Caboolture, we are committed to ensuring our studio operates harmoniously within the surrounding community. To support our 24/7 operations and maintain a peaceful environment, all members are required to adhere to the following Noise Policy. By agreeing to these Terms and Conditions, you acknowledge and accept the responsibilities outlined below.

General Studio Noise Rules (Applies at All Times):

· No music is to be played aloud in the studio. All audio must be listened to using headphones.

· Equipment is to be used responsibly and quietly at all times.

· Loud talking, yelling, or disruptive behaviour is strictly prohibited inside the studio and in the car park.

· Entry and exit must be made via the main entrance off Rowe Street only.

After-Hours Noise Rules (9:00pm to 6:00am):

· Use of the car park is restricted to the Rowe Street shop complex only.

· Doors must remain fully closed at all times while inside the studio.

· No loud conversations or disturbances in the car park or near neighbouring premises.

Your Responsibilities as a Member:

· You agree to comply with all noise restrictions and respect the studio’s residential and commercial neighbours.

· You agree to follow any direction provided by CorFit Pilates staff or automated notices relating to noise management.

· You understand that failure to comply may result in disciplinary action, including suspension or cancellation of your membership.

Noise Complaints & Monitoring:

· CorFit Pilates maintains a Noise Complaints Register to document and investigate any reported issues.

· If a complaint is found to relate to your activity, you will be contacted via phone, email, or in person to discuss the matter.

· Ongoing or serious breaches may lead to a formal warning or membership termination.

By becoming a member of CorFit Pilates, you agree to uphold these conditions as part of your ongoing membership obligations.

5. Health and Safety

5.1. Members must be in good physical condition and free from any injury or condition that could be aggravated by exercise. 5.2. It is the Member’s responsibility to consult a medical professional before commencing physical activity. If in doubt, participation should be postponed until clearance is received. 5.3. CorFit Pilates and its staff are not qualified to provide medical advice and do not make representations regarding the safety or suitability of any exercise program. 5.4. If a Member experiences dizziness, fainting, pain, or shortness of breath during a session, they must cease exercise and seek immediate medical attention. 5.5. Any injury or incident occurring on the premises must be reported immediately to CorFit Pilates via the app or email.

6. Orientation

6.1. All new Members must complete a compulsory orientation session before using the facilities. 6.2. Orientation includes familiarisation with the studio layout, emergency procedures, equipment, app usage, and health disclaimers. 6.3. We reserve the right to deny access to Members who fail to complete orientation or demonstrate unsafe behaviour.

7. Surveillance and Security

7.1. The studio is monitored by 24-hour CCTV for security and safety purposes. By accessing the premises, Members consent to being recorded. 7.2. Surveillance is reviewed in the event of an incident, dispute, or suspected breach.

8. Equipment

8.1. Equipment is sourced from third-party suppliers. CorFit Pilates makes no warranty regarding the manufacture of equipment. 8.2. Members use all equipment at their own risk. Misuse or damage may result in liability for repair or replacement costs.

9. Kiosk System

9.1. Our workouts are delivered through a touchscreen kiosk using the "Your Reformer" program. 9.2. These workouts are generalised and not individually tailored. Members must self-monitor and adjust based on their personal capabilities. 9.3. CorFit Pilates is not liable for injury, discomfort, or dissatisfaction resulting from kiosk use. Improper use of kiosks or following programs against medical advice is at the Member’s own risk. 9.4. Members indemnify CorFit Pilates and its staff against any claims, damages, or losses arising from the use of kiosk systems.

10. Personal Property

10.1. Members are responsible for their personal belongings. CorFit Pilates does not accept responsibility for loss, theft, or damage to personal items. 10.2. Any property left on premises unclaimed for 14 days may be disposed of.

11. Termination

11.1. We may terminate a membership at our sole discretion for reasons including:

· Breach of this Agreement

· Disruptive or unsafe behaviour

· Non-payment of fees

· Sharing access with non-members

· Illegal or offensive conduct 11.2. Any fees outstanding at the time of termination remain payable. 11.3. If a Member passes away or is permanently incapacitated, a refund of unused membership fees may be granted upon evidence. 11.4. Terminated Members may be barred from future re-registration.

12. Amendments

12.1. CorFit Pilates may update this Agreement at any time. 12.2. Members will be notified of updates via email or app notification. Continued use of services implies acceptance of changes.

13. Risk Warning

13.1. Members acknowledge the inherent risks of using reformer Pilates equipment and engaging in physical activity. 13.2. These risks include but are not limited to injury, illness, strain, and death. Participation is entirely voluntary and undertaken at the Member’s own risk. 13.3. CorFit Pilates disclaims all liability for injuries resulting from negligence, misuse, or unforeseeable circumstances.

14. Marketing and Media

14.1. CorFit Pilates may capture photos or videos for promotional purposes. By entering the premises, Members grant consent unless otherwise requested in writing. 14.2. No compensation is provided for promotional use.

15. Liability Waiver

15.1. To the extent permitted by law, CorFit Pilates disclaims liability for any injury, loss, or damage suffered by Members while on premises or using services. 15.2. Members accept all risks and agree not to pursue legal action for injuries resulting from ordinary negligence.

16. Entire Agreement

16.1. This Agreement constitutes the entire agreement between the parties. 16.2. No oral statements or representations override these terms.
